の方がはるかに好ましいでしょう。
「尚、上記の補正などの示唆は法律的効果を生じさせるものではなく、拒絶理由を解消するための一案である。」という一文を英訳するなら、
The suggestion on amendments and the like described above does not constitute the legal effect, and is merely offered as one of possible ways of overcoming the reasons for rejection.
ではなく、
Suggestions on matters such as amendments that have been made above should not be regarded as having any binding legal effect, and but are offered merely as one of the possible ways of overcoming the reasons for rejection that have been set out above.
が適切です。この文において押さえるべき基本事項の1つは「suggestions」の使い方で、「suggestions are described」ではなく「suggestions are made」です。もう1点は「法律的な効果を生じさせる」という表現で、「have binding legal effect」と訳すのが通例です。
「補正後の請求項2-10」に相当する英語表現は、
claims 2-10 after the amendment have been performed
ではなく、
claims 2 to 10, as amended
が適切かつ自然です。 |
